By accessing or using our website, requesting information, scheduling an appointment, participating in telehealth services, receiving care from our practice, or otherwise interacting with Arise Psychiatric Urgent Care, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, as well as our Privacy Policy and any other applicable policies or agreements.

If you do not agree with these Terms, you should discontinue use of our website and services.

These Terms apply to all website visitors, patients, prospective patients, parents or legal guardians, caregivers, authorized representatives, and any individual who accesses or uses the services provided by Arise Psychiatric Urgent Care.

Arise Psychiatric Urgent Care reserves the right to modify or update these Terms at any time to reflect changes in applicable laws, regulations, business practices, technology, or the services we provide. Updated Terms will become effective upon posting to our website unless otherwise required by applicable law. Your continued use of our website or services following the posting of revised Terms constitutes your acceptance of those revisions, to the extent permitted by law.

These Terms are intended to establish the conditions governing the use of our website and services and should be read in conjunction with our Privacy Policy and other applicable patient forms, consents, and notices provided by Arise Psychiatric Urgent Care.

2. About Arise Psychiatric Urgent Care

Arise Psychiatric Urgent Care is a California-based behavioral healthcare practice dedicated to providing timely, compassionate, and evidence-based psychiatric services for children, adolescents, and adults experiencing urgent mental health concerns. Our mission is to improve access to high-quality psychiatric care by offering prompt evaluation and treatment in a safe, supportive, and patient-centered environment.

Our practice is designed to bridge the gap between traditional outpatient psychiatric care and hospital emergency departments by providing same-day and next-available access to mental health services whenever possible. Patients may access care through walk-in visits, scheduled appointments, telehealth services, or other available methods of appointment scheduling.

Services offered by Arise Psychiatric Urgent Care may include psychiatric evaluations, diagnostic assessments, medication management, crisis assessment, brief therapeutic interventions, treatment planning, coordination of care, and referrals to community resources or higher levels of care when clinically appropriate.

Our providers are committed to delivering individualized care that respects each patient’s unique needs, cultural background, personal values, and treatment goals. We believe in partnering with patients and, when appropriate, their families or caregivers to promote long-term mental wellness through evidence-based treatment and collaborative decision-making.

Arise Psychiatric Urgent Care is committed to maintaining the highest standards of professionalism, patient safety, confidentiality, and ethical medical practice while complying with all applicable federal and California laws governing healthcare delivery.

The information contained within these Terms & Conditions governs the use of our website and services and is intended to establish clear expectations regarding the relationship between Arise Psychiatric Urgent Care and those who access or utilize our services.

3. Medical Disclaimer

The information provided on the Arise Psychiatric Urgent Care website, patient education materials, social media platforms, and other communications is intended for general informational and educational purposes only. It is not intended to constitute medical advice, psychiatric advice, diagnosis, treatment, or the establishment of a provider-patient relationship.

No information contained on this website or provided through our online resources should be relied upon as a substitute for a comprehensive evaluation, diagnosis, or treatment by a qualified healthcare professional. Every individual’s medical and mental health needs are unique, and treatment decisions should be made in consultation with an appropriately licensed healthcare provider.

Use of this website, submission of online forms, electronic communications, appointment requests, or participation in telehealth scheduling does not, by itself, establish a provider-patient relationship with Arise Psychiatric Urgent Care or any of its providers. A provider-patient relationship is established only after a patient has been evaluated by a qualified provider and both the patient and provider have mutually agreed to enter into a treatment relationship.

Although Arise Psychiatric Urgent Care strives to provide accurate, current, and reliable information, we make no representations or warranties regarding the completeness, accuracy, reliability, or applicability of any information presented on our website or through our communications. Medical knowledge and standards of care continue to evolve, and information may change without notice.

Individuals should not delay seeking professional medical or psychiatric care, disregard medical advice, or discontinue prescribed treatment based on information obtained from this website or other materials provided by Arise Psychiatric Urgent Care.

If you are experiencing a medical or psychiatric emergency, do not rely on this website or electronic communications to obtain assistance. Emergency situations require immediate attention through appropriate emergency services as described in the following sections of these Terms & Conditions.

4. Psychiatric Urgent Care Disclaimer

Arise Psychiatric Urgent Care provides evaluation and treatment for urgent, non-life-threatening mental health conditions requiring prompt psychiatric assessment and intervention. Our practice is designed to improve timely access to behavioral healthcare by offering services that bridge the gap between routine outpatient psychiatric care and hospital emergency departments.

While we strive to provide same-day or next-available care whenever possible, Arise Psychiatric Urgent Care is not an emergency department, crisis stabilization unit, inpatient psychiatric facility, or substitute for emergency medical services. Our providers evaluate each patient individually to determine the most appropriate level of care based on the patient’s clinical presentation, available resources, and professional medical judgment.

The availability of services, appointment times, specific treatments, diagnostic testing, medications, or referrals may vary based on provider availability, clinical appropriateness, and other operational considerations. Receipt of an evaluation does not guarantee admission into ongoing treatment, prescription of medication, issuance of disability documentation, completion of requested forms, or any specific diagnosis or treatment recommendation.

Treatment decisions are made solely at the discretion of the evaluating provider based on accepted medical standards, applicable laws and regulations, patient safety, and the provider’s independent clinical judgment.

If a patient’s condition exceeds the scope of services that can be safely provided within a psychiatric urgent care setting, Arise Psychiatric Urgent Care may recommend referral or transfer to another healthcare provider, emergency department, inpatient psychiatric facility, or other appropriate level of care. Our primary responsibility is to ensure that each patient receives care in the setting most appropriate for their individual needs.

Nothing contained within these Terms & Conditions, our website, or our communications should be interpreted as a guarantee of treatment, specific medical outcomes, or the availability of any particular service.

5. Emergency & Crisis Notice

Arise Psychiatric Urgent Care is designed to provide timely evaluation and treatment for urgent, non-life-threatening mental health concerns. While our providers are experienced in assessing a wide range of behavioral health conditions, our clinic is not an emergency department and is not equipped to provide emergency medical stabilization or inpatient psychiatric services.

If you are experiencing a life-threatening medical or psychiatric emergency, do not delay seeking emergency care. Call 911 immediately or go to the nearest emergency department.

Examples of emergencies requiring immediate emergency services may include, but are not limited to:

  • An active suicide attempt or self-inflicted injury;
  • Active suicidal thoughts with intent, plan, or imminent risk of self-harm;
  • Active homicidal thoughts with intent or imminent risk of harming others;
  • Drug overdose or suspected poisoning;
  • Loss of consciousness or seizure;
  • Severe psychosis resulting in immediate danger to yourself or others;
  • Violent, aggressive, or uncontrollable behavior creating an immediate safety risk; or
  • Any medical condition requiring emergency medical treatment.

Individuals experiencing emotional distress, thoughts of suicide, or a mental health crisis may also contact the 988 Suicide & Crisis Lifeline by calling or texting 988, available 24 hours a day, 7 days a week.

If, during an evaluation, a provider determines that your condition requires a higher level of care than can be safely provided within a psychiatric urgent care setting, you may be referred or transferred to an emergency department, inpatient psychiatric facility, or other appropriate healthcare provider to ensure your safety and well-being.

The safety of our patients, staff, and community remains our highest priority. Decisions regarding the appropriate level of care are made using the independent clinical judgment of the evaluating provider and applicable standards of medical practice.

6. Appropriate Use of Psychiatric Urgent Care

Arise Psychiatric Urgent Care is intended to provide prompt evaluation and treatment for individuals experiencing urgent mental health concerns that require timely attention but do not require emergency medical intervention or inpatient psychiatric hospitalization.

Examples of conditions that may be appropriate for evaluation at Arise Psychiatric Urgent Care include, but are not limited to:

  • Anxiety or panic attacks;
  • Depression or worsening depressive symptoms;
  • Mood changes or mood instability;
  • Increased stress or emotional distress;
  • Medication concerns, including side effects or urgent medication adjustments;
  • Behavioral or emotional concerns;
  • Difficulty sleeping related to a mental health condition;
  • Attention-Deficit/Hyperactivity Disorder (ADHD) evaluations or medication concerns;
  • Urgent psychiatric evaluations;
  • Concerns related to trauma, grief, or significant life changes; and
  • Other non-life-threatening behavioral health concerns requiring prompt psychiatric assessment.

Patients are encouraged to seek emergency medical care rather than psychiatric urgent care if they are experiencing conditions that require immediate medical stabilization, including, but not limited to:

  • An active suicide attempt or imminent risk of self-harm;
  • Active homicidal thoughts with intent or imminent risk of harming others;
  • Violent or uncontrolled behavior posing an immediate safety risk;
  • Drug overdose or suspected poisoning;
  • Loss of consciousness or other medical emergencies; or
  • Any condition that requires emergency medical or inpatient psychiatric treatment.

The examples provided above are intended for informational purposes only and are not exhaustive. Every patient is evaluated individually, and the determination of whether treatment can be safely provided within a psychiatric urgent care setting will be made by the evaluating provider based on the patient’s clinical presentation, medical history, safety considerations, and professional judgment.

If Arise Psychiatric Urgent Care determines that another level of care is more appropriate, patients may be referred to an emergency department, inpatient psychiatric facility, another healthcare provider, or community resources to ensure they receive the most appropriate treatment.

7. Appointment Scheduling

Arise Psychiatric Urgent Care is committed to providing timely access to behavioral healthcare through a variety of convenient scheduling options. Depending on provider availability and clinical needs, patients may access services by:

  • Walking into the clinic during posted business hours;
  • Scheduling an appointment online through our website;
  • Calling our office to schedule an appointment; or
  • Scheduling and participating in a telehealth appointment, when clinically appropriate.

While Arise Psychiatric Urgent Care strives to accommodate walk-in patients whenever possible, walk-in services are subject to provider availability, patient volume, and the urgency of presenting concerns. Wait times may vary based on the number of patients seeking care and the clinical priority of each patient.

Scheduling an appointment or checking in as a walk-in does not guarantee immediate evaluation or treatment. Patients are seen based on provider availability, operational capacity, and clinical judgment.

Arise Psychiatric Urgent Care reserves the right to reschedule appointments, modify scheduling practices, or refer patients to another provider or level of care when necessary to ensure patient safety, maintain quality of care, or comply with applicable laws and professional standards.

Patients are encouraged to arrive on time, complete all requested registration and intake forms, provide accurate insurance and demographic information, and notify the practice as soon as possible if they are unable to keep a scheduled appointment.

Patients who require immediate emergency medical or psychiatric care should not delay treatment while attempting to schedule an appointment and should instead call 911 or proceed to the nearest emergency department.

8. Telehealth Terms & Consent

Arise Psychiatric Urgent Care may offer telehealth services to eligible patients when clinically appropriate and in accordance with applicable federal and California laws. Telehealth allows patients to receive certain psychiatric services through secure audio and/or video communication technology without being physically present in the office.

Telehealth services may not be appropriate for every patient or every clinical situation. The decision to provide services through telehealth is made solely at the discretion of the treating provider based on the patient’s clinical needs, safety considerations, technological capabilities, and applicable legal requirements.

Patients participating in telehealth appointments agree to:

  • Provide accurate identifying information before the appointment;
  • Participate from a private location that supports confidentiality whenever reasonably possible;
  • Utilize a device and internet connection capable of supporting the telehealth visit;
  • Notify the provider of their physical location at the beginning of the appointment, when requested, to comply with applicable laws and facilitate emergency response if necessary;
  • Minimize distractions during the appointment to support effective communication and treatment; and
  • Inform the provider if another individual is present during the visit.

Although Arise Psychiatric Urgent Care utilizes secure technology designed to protect patient privacy, electronic communications may be subject to technical failures, interruptions, unauthorized access, or other risks beyond our control. No electronic communication system can guarantee absolute security or uninterrupted service.

Telehealth appointments may be interrupted, rescheduled, or converted to an in-person visit if technical difficulties prevent the provider from conducting an adequate clinical evaluation or if the provider determines that an in-person assessment or another level of care is medically appropriate.

Participation in telehealth services constitutes acknowledgment of the potential benefits and limitations of remote healthcare delivery. Additional telehealth consent forms may be required prior to receiving telehealth services, and patients are responsible for reviewing and completing all required documentation before their appointment.

Arise Psychiatric Urgent Care reserves the right to discontinue or decline telehealth services when clinically appropriate, when required by law, or when patient safety cannot be adequately maintained through virtual care.

9. Controlled Substance Policy

Arise Psychiatric Urgent Care is committed to the safe, responsible, and legally compliant prescribing of controlled substances. Controlled medications are prescribed only when medically necessary and clinically appropriate, as determined by the treating provider in accordance with applicable federal and California laws, accepted medical standards, and professional judgment.

The prescribing of controlled substances is never guaranteed. Requests for specific medications, dosages, or treatment plans do not obligate a provider to prescribe a controlled substance. All prescribing decisions are made solely at the discretion of the evaluating provider based on the patient’s medical history, current clinical presentation, prior treatment records, safety considerations, and applicable prescribing guidelines.

Prior to prescribing certain controlled medications, Arise Psychiatric Urgent Care may require one or more of the following:

  • Verification of the patient’s identity;
  • Review of prior medical or psychiatric records;
  • Communication with previous or current treating providers, when appropriate and authorized;
  • Review of the California Controlled Substance Utilization Review and Evaluation System (CURES);
  • Completion of additional evaluations or assessments;
  • Drug screening or other clinically appropriate testing; and
  • Follow-up appointments to monitor treatment response, medication effectiveness, safety, and compliance.

Patients are expected to take all medications exactly as prescribed and to notify their provider of any significant side effects, medication concerns, changes in other prescribed medications, or changes in their medical condition.

Arise Psychiatric Urgent Care reserves the right to decline, discontinue, or modify controlled substance treatment when clinically appropriate, when patient safety is a concern, when misuse or diversion is suspected, when treatment recommendations are not followed, or when otherwise permitted or required by law.

Patients are responsible for safeguarding their medications. Lost, stolen, damaged, or prematurely exhausted controlled medications may not be replaced, and requests for early refills will be evaluated on a case-by-case basis in accordance with applicable laws, clinical judgment, and office policies.

Nothing in these Terms & Conditions shall be interpreted as creating an obligation for Arise Psychiatric Urgent Care or its providers to prescribe any specific medication, including controlled substances.

10. Prescription Refill Policy

Arise Psychiatric Urgent Care is committed to ensuring the safe and appropriate management of prescription medications. Prescription refills are provided based on medical necessity, continuity of care, applicable laws and regulations, and the independent clinical judgment of the treating provider.

Prescription refill requests should be submitted during normal business hours through the patient portal, by telephone, or by another communication method approved by Arise Psychiatric Urgent Care. Patients are encouraged to request refills sufficiently in advance of running out of medication to allow adequate time for clinical review and processing.

Prescription refill requests are not guaranteed and may require:

  • A follow-up appointment or clinical evaluation;
  • Review of the patient’s medical record;
  • Review of medication history;
  • Completion of recommended laboratory testing, when clinically indicated;
  • Compliance with treatment recommendations; or
  • Additional documentation as determined by the treating provider.

Certain medications, including controlled substances, may be subject to additional prescribing requirements, monitoring, or restrictions in accordance with federal and California law, clinical guidelines, and Arise Psychiatric Urgent Care policies.

Prescription refill requests submitted after normal business hours, on weekends, or during holidays may not be reviewed until the next business day. Patients should plan accordingly and should not wait until medication has been exhausted before requesting a refill.

Arise Psychiatric Urgent Care does not guarantee same-day prescription refills or emergency refills. Providers reserve the right to deny, delay, modify, or discontinue prescription medications when clinically appropriate or when required by law.

Patients should not use email, text messaging, website contact forms, or social media to request urgent prescription refills unless specifically instructed by the practice. Prescription requests submitted through unauthorized communication methods may not receive a timely response.

If a patient experiences a medication-related emergency, severe adverse reaction, overdose, or other urgent medical concern, they should call 911, contact their local poison control center when appropriate, or seek immediate medical attention at the nearest emergency department.

11. Insurance & Self-Pay

Arise Psychiatric Urgent Care accepts a variety of insurance plans and offers self-pay options for patients who are uninsured or whose insurance coverage does not include the services provided. Insurance participation, covered services, and reimbursement policies may change without notice.

As a courtesy, Arise Psychiatric Urgent Care may verify insurance eligibility and submit claims to participating insurance carriers on behalf of patients. However, insurance verification is not a guarantee of coverage, payment, or reimbursement. Final determination of benefits and payment remains the responsibility of the patient’s insurance carrier.

Patients are responsible for providing complete and accurate insurance information prior to receiving services and for promptly notifying the practice of any changes to their insurance coverage or personal information.

Patients are financially responsible for all services provided that are not covered by insurance, including but not limited to deductibles, copayments, coinsurance, non-covered services, or services denied by an insurance carrier. Payment may be required at the time services are rendered in accordance with Arise Psychiatric Urgent Care’s financial policies.

Self-pay patients are responsible for payment of all applicable fees at the time of service unless other arrangements have been approved by the practice.

If an insurance carrier denies or reduces payment after services have been provided, the patient may be responsible for any remaining balance in accordance with applicable laws, contractual obligations, and the terms of their insurance plan.

Questions regarding insurance coverage, benefits, or payment responsibilities should be directed to your insurance carrier. Questions regarding billing or payment for services provided by Arise Psychiatric Urgent Care may be directed to our office during normal business hours.

Nothing in these Terms & Conditions shall be construed as a guarantee that any service provided by Arise Psychiatric Urgent Care will be covered, reimbursed, or paid by an insurance company or other third-party payer.

12. Missed Appointments & Cancellations

Arise Psychiatric Urgent Care strives to provide timely access to care for all patients. To help us serve our community efficiently, patients with scheduled appointments are encouraged to arrive on time and notify the practice as soon as possible if they are unable to keep their appointment.

Patients who need to cancel or reschedule a scheduled appointment should contact the office as far in advance as reasonably possible. Providing advance notice allows appointment times to be made available to other patients seeking care.

Patients who arrive significantly late for a scheduled appointment may be asked to reschedule if there is insufficient time remaining to safely complete the evaluation or treatment. Whenever possible, Arise Psychiatric Urgent Care will make reasonable efforts to accommodate late arrivals based on provider availability and clinical circumstances.

Repeated missed appointments, frequent late cancellations, or patterns of failure to appear for scheduled appointments may affect a patient’s ability to schedule future appointments and may result in additional scheduling requirements or other administrative actions, consistent with applicable law and practice policies.

Walk-in patients are evaluated based on provider availability, patient volume, and clinical priority. While every effort is made to accommodate walk-in visits, Arise Psychiatric Urgent Care cannot guarantee immediate evaluation or treatment, and patients may experience varying wait times depending on clinic operations and the urgency of presenting concerns.

Nothing in this section limits the ability of Arise Psychiatric Urgent Care to prioritize patient care based on medical necessity, provider availability, patient safety, or other operational considerations.

13. Minors & Parent/Guardian Consent

Arise Psychiatric Urgent Care provides psychiatric services to children, adolescents, and adults in accordance with applicable federal and California laws governing consent for treatment.

Except where otherwise permitted or required by law, a parent, legal guardian, or other individual authorized to consent to treatment on behalf of a minor must provide consent prior to the delivery of healthcare services. Arise Psychiatric Urgent Care reserves the right to request documentation verifying legal guardianship, custody, or other authority to consent to treatment.

Parents, legal guardians, and authorized representatives may be asked to participate in portions of the evaluation or treatment process when clinically appropriate and consistent with applicable privacy laws. However, providers may also meet privately with minor patients when necessary to facilitate appropriate clinical assessment, encourage open communication, or comply with legal or ethical obligations.

Certain healthcare services may be provided to minors without parental consent when permitted under California law. In such circumstances, Arise Psychiatric Urgent Care will comply with all applicable legal requirements regarding confidentiality, consent, and disclosure of information.

Individuals providing consent on behalf of a minor represent that they have the legal authority to do so and agree to provide accurate and complete information regarding custody arrangements, guardianship, court orders, or other legal restrictions that may affect treatment decisions.

Arise Psychiatric Urgent Care reserves the right to postpone or decline non-emergency treatment if questions arise regarding legal authority to consent, patient safety, or compliance with applicable laws until appropriate documentation or clarification has been obtained.

14. Electronic Communications

Arise Psychiatric Urgent Care offers various methods of electronic communication to improve access to care and enhance the patient experience. Depending on the services provided, patients may communicate with the practice through the patient portal, email, text messaging (SMS), telehealth platforms, online appointment requests, website contact forms, or other electronic means approved by the practice.

Electronic communications are intended to facilitate routine administrative matters and certain aspects of patient care. However, not all communication methods are appropriate for every type of request, and patients should exercise discretion when choosing how to contact the practice.

Patients acknowledge and agree that:

  • Electronic communications may not be monitored continuously or responded to immediately.
  • Response times may vary depending on the nature of the request, provider availability, business hours, weekends, holidays, or other operational considerations.
  • Electronic communications should not be relied upon for urgent medical or psychiatric concerns.
  • Certain requests may require an in-person appointment or telehealth evaluation before they can be addressed.
  • Arise Psychiatric Urgent Care reserves the right to determine the most appropriate method of communication based on the circumstances of each request.

While Arise Psychiatric Urgent Care makes reasonable efforts to utilize secure communication methods and protect patient privacy, patients acknowledge that electronic communications carry inherent risks, including delays, technical failures, unauthorized access, or interception despite reasonable security safeguards.

Patients are responsible for providing accurate and current contact information and for notifying the practice promptly of any changes to their telephone number, mailing address, email address, or other preferred communication methods.

Arise Psychiatric Urgent Care reserves the right to discontinue or limit electronic communications when necessary to protect patient privacy, maintain security, comply with applicable law, or ensure the safe delivery of healthcare services.

15. Text Messaging & Email Risks

As a convenience, Arise Psychiatric Urgent Care may communicate with patients by email or text message (SMS) for purposes such as appointment reminders, scheduling updates, billing notifications, and other administrative or limited healthcare-related communications.

By providing an email address and/or mobile telephone number, you consent to receiving communications from Arise Psychiatric Urgent Care through these methods, unless you choose to opt out where permitted by law.

While Arise Psychiatric Urgent Care takes reasonable precautions to protect the privacy and confidentiality of patient information, email and text messaging are not completely secure methods of communication. These communications may be subject to delays, delivery failures, unauthorized access, interception, or other security risks beyond our control.

By electing to communicate through email or text messaging, you acknowledge and accept these inherent risks.

Patients are responsible for:

  • Providing accurate and current contact information;
  • Maintaining the security of their personal email accounts and mobile devices;
  • Promptly notifying the practice of any changes to their contact information; and
  • Informing the practice if they no longer wish to receive electronic communications, when applicable.

Patients should not transmit highly sensitive medical information through unsecured email or text messaging unless specifically instructed by Arise Psychiatric Urgent Care. Whenever available, the secure patient portal should be used for communications involving Protected Health Information.

Email and text messaging should never be used to report medical emergencies, psychiatric emergencies, or other time-sensitive situations. These communication methods are not monitored continuously, and Arise Psychiatric Urgent Care cannot guarantee immediate review or response.

Arise Psychiatric Urgent Care reserves the right to discontinue electronic communications with any patient when necessary to protect patient privacy, comply with applicable law, maintain system security, or ensure the safe delivery of healthcare services.

16. Patient Responsibilities

To promote safe, effective, and high-quality care, patients receiving services from Arise Psychiatric Urgent Care agree to the following responsibilities:

  • Provide complete, accurate, and current information regarding their medical history, mental health history, medications, allergies, insurance coverage, and contact information.
  • Inform the practice promptly of any changes to personal information, insurance coverage, medications, or significant changes in their health or mental health status.
  • Participate honestly and actively in the evaluation and treatment process by providing accurate information and communicating concerns, symptoms, and treatment goals.
  • Follow treatment recommendations and prescribed medication instructions or discuss any concerns with their provider before making changes to their treatment plan.
  • Attend scheduled appointments or notify the practice as soon as reasonably possible if an appointment must be canceled or rescheduled.
  • Treat providers, staff, patients, and visitors with courtesy, dignity, and respect. Harassing, threatening, abusive, discriminatory, or violent behavior toward staff, providers, patients, or visitors will not be tolerated and may result in the termination of services or other appropriate action consistent with applicable law.
  • Safeguard prescribed medications and use them only as directed by the treating provider.
  • Notify the practice of any adverse medication reactions, hospitalization, emergency psychiatric treatment, or other significant events that may affect ongoing care.
  • Understand that medical recommendations, prescriptions, referrals, and treatment decisions are based upon the independent clinical judgment of the treating provider and may change as a patient’s condition evolves.
  • Comply with the policies and procedures of Arise Psychiatric Urgent Care and cooperate with reasonable requests necessary to provide safe, effective, and legally compliant healthcare services.

By receiving services from Arise Psychiatric Urgent Care, patients acknowledge their shared responsibility in maintaining open communication, participating in treatment, and supporting a safe, respectful, and therapeutic environment for everyone involved in their care.

20. Limitation of Liability

To the fullest extent permitted by applicable law, Arise Psychiatric Urgent Care, its owners, physicians, providers, employees, contractors, agents, affiliates, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the use of, or inability to use, our website, online services, patient portal, telehealth services, electronic communications, or other non-emergency services.

While Arise Psychiatric Urgent Care is committed to providing high-quality, evidence-based psychiatric care, we do not guarantee any particular medical outcome, diagnosis, treatment result, recovery, or improvement in a patient’s condition. Medical and psychiatric treatment involves individualized clinical judgment, and outcomes may vary from person to person.

Arise Psychiatric Urgent Care makes reasonable efforts to maintain accurate and current information on its website and to provide reliable services. However, we do not warrant that our website, electronic communications, telehealth platforms, or other digital services will be uninterrupted, error-free, secure, or free from viruses, malware, or other harmful components.

Nothing contained on our website or within these Terms & Conditions shall be interpreted as creating a guarantee of treatment, availability of services, appointment availability, prescription of any specific medication, insurance coverage, or the establishment of a provider-patient relationship prior to an appropriate clinical evaluation.

Nothing in this section is intended to limit or waive any rights, remedies, duties, or obligations that cannot legally be limited or disclaimed under applicable federal or California law. To the extent any limitation contained herein is prohibited by law, that limitation shall apply only to the maximum extent permitted by law.

21. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Arise Psychiatric Urgent Care, its owners, physicians, providers, employees, contractors, agents, affiliates, successors, and assigns from and against any claims, demands, actions, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising out of or relating to:

This indemnification obligation shall not apply to claims arising solely from the gross negligence, willful misconduct, or other liability of Arise Psychiatric Urgent Care where such liability cannot be limited or disclaimed under applicable law.

The obligations set forth in this section shall survive the termination of your use of the website or services to the extent permitted by law.

22. Governing Law

These Terms & Conditions, as well as any dispute arising out of or relating to your use of the Arise Psychiatric Urgent Care website, digital services, telehealth services, or other services provided by the practice, shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

To the extent permitted by applicable law, any legal action or proceeding arising from or relating to these Terms & Conditions or the use of Arise Psychiatric Urgent Care’s services shall be brought in a court of competent jurisdiction located within the State of California.

Nothing contained in these Terms & Conditions shall be interpreted to limit or waive any rights, protections, remedies, or obligations that are required under applicable federal or California law governing the delivery of healthcare services.

23. Severability

If any provision of these Terms & Conditions is determined by a court of competent jurisdiction or other applicable legal authority to be invalid, illegal, unenforceable, or

otherwise ineffective, that provision shall be enforced to the fullest extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.

Any invalid, illegal, or unenforceable provision shall be interpreted or modified, to the extent legally permissible, so as to most closely reflect the original intent of the provision while maintaining its validity and enforceability.

The failure of Arise Psychiatric Urgent Care to enforce any provision of these Terms & Conditions shall not constitute a waiver of that provision or of any other rights available under these Terms or applicable law.

These Terms & Conditions shall continue in effect notwithstanding the invalidity or unenforceability of any individual provision.
